What BC Law Says You’re Owed

The Employment Standards Act sets the minimum: up to 8 weeks’ pay, depending on how long you worked there. That’s the floor.

Common law can go much higher. Courts look at your age, your role, your years of service, and how long it may take to find similar work. Awards can reach up to 24 months’ pay.

Say you’ve worked somewhere for 12 years and earn $90,000. The legal minimum is about 8 weeks, or roughly $13,800. A common law claim could be worth 12 months’ pay or more. Your employment contract can change that math, so we read it first.

How much severance am I entitled to in BC?
It depends on your years of service, age, role, and the job market. The legal minimum is up to 8 weeks’ pay. Common law awards can reach 24 months, unless a valid contract limits you to less. A severance review gives you a number for your situation.

Should I sign my severance offer?
Not until you know what you’re giving up. Offers usually come with a release, and signing it ends your right to claim more. You can ask your employer for extra time to get advice.

What is wrongful dismissal?
It’s when your employer lets you go without cause and without enough notice, or enough pay in place of notice. It usually comes down to how much you were owed.

How long do I have to make a claim?
6 months for a complaint under the Employment Standards Act, and 2 years to start a wrongful dismissal lawsuit. The deadline on a severance offer can be much shorter.

Can I afford a lawyer after losing my job?
The severance review is a flat $350. If we negotiate for you, the settlement uplift is paid from money we recover above the first offer.
